Terms and Conditions

You must agree to these Terms and Conditions (TaC) to access the www.dirtyroad.org services and to create an account.

Note: we’ll update the Terms of Service as we approach the full launch and clarify the reasons and ways in which we may terminate or ban accounts as we develop these processes and
solidify our moderation process.

This is version 1.0 of the Terms of Service, last updated on 28th of February, 2023.

This document constitutes the Dirtyroad Terms of Use (ToU) which govern the relationship between Dirtyroad (the provider of the service “Dirtyroad“) and you, as a user of the Dirtyroad service. In any disputes, argentinian law is applicable.

By creating an account and a profile on Dirtyroad, you consent to Dirtyroad and other Dirtyroad members using the personal data that you provide for the purposes of hospitality and exchange. Dirtyroad supports hospitality exchanges in many countries, so some of this data may be used outside of the EU.

1. Service provider

Access to the www.dirtyroad.org platform (“platform”, “service”) is provided to you by the Dirtyroad, Inc. (“www.dirtyroad.org”, “we”, “us”).

2. Eligibility

You must be at least 18 years old to access the service. Our site, products and services are all directed to people who are at least 13 years old or older. If this server is in the USA, and you are under the age of 13, per the requirements of COPPA (Children’s Online Privacy Protection Act), do not use this site.

3. Account information

You are responsible for any activity done using your account, as well as securing your account from inappropriate access.
For example, you must use a secure password not shared across other products or services, and you cannot leave your account logged in on shared computers.
If you give access to your account to others for any purpose, you are liable for any such activity.

You must provide truthful and current information on your account. Your display name does not need to be your legal name. We only save your location (i.e. latitude and longitude), NOT your address.

You may hide or obfuscate information on your public profile for your own privacy or security, but you may not do so in a way that would reasonably deceive other users.
Information used in verification must be truthful and accurate, this includes your birth date, your gender identity and your legal name.

4. Liability and your interactions with others

dirtyroad.org provides a platform for users to contact one another and organize activities together. You agree to not hold us liable or responsible for user-created content
or for interactions between users, including online and in person. You are solely liable and responsible for your actions on the platform,
including any interactions with other users and any content that you create.

Although we are not legally responsible for user-created content, we actively moderate the platform to remove any content that is harmful, deceitful, or otherwise does not adhere to our rules.
If you believe some content does not adhere to our rules, please report it to us via support@dirtyroad.org.

When posting any image, you agree to obtain consent from any individual pictured in the image.

We are not liable if at any time, with or without prior notice, we modify, suspend or discontinue our services.

5. Data privacy and security

We collect data required to provide you with the service, such as your profile information, your email address, and other data. We use cookies to keep you logged in.
We take the protection of your data very seriously. All communication between you and the platform is encrypted with transport security (SSL/TLS), and data is stored securely on servers in accordance with industry standards.

We want to make dirtyroad.org the best platform possible, so we additionally collect analytics data for the following reasons: to help us grow the platform (by finding out what kind of content and services appeal to users), to help us fix bugs and improve the experience for you and other users (e.g. so we can spend time on features you actually use), and for purposes of user safety and content moderation (e.g. to understand usage patterns by adversarial users).

The analytics data we collect includes things like how users found us, what pages they read before signing up, what features they use on the platform, as well as debugging information such as: automated bug reporting, analytics on error rates, exception rates, and timings of different backend functionality. We believe this is necessary for the purpose of getting a full view into how the site is used and what the community wants from the platform. For now we use third-party tools for the client-side analytics, but we would like to build our own tooling to be able to better tailor it to the platform, please let us know if you would like to help us in this effort!

We do not sell any user data and will only use or process it for purposes in line with our policies as well as our non-profit, community-led mission.

6. Conduct

You agree to use Dirtyroad for its designated purposes – hospitality and cultural exchange – and to contribute to furthering these purposes in a strictly non-commercial way, free of charge. Failure to comply with this can result in your membership of Dirtyroad being cancelled without further notice.

The following are some examples of what you agree NOT to do on Dirtyroad:

  • Use Dirtyroad for any illegal or disruptive activities;
  • Provide any information that is false or misleading;
  • Violate the rights of any third party;
  • Attack, defame or make discriminatory statements about any other people or groups of people;
  • Molest, mob, stalk, harass, threaten, or intimidate any other user of our services, including Dirtyroad team members;
  • Post content that is threatening, contains graphic violence, or incites or glorifies violence or harm against self or others;
  • Collect or store any information you obtain through our services for any unauthorized purpose;
  • Use our services for any commercial purpose, especially for the distribution of commercial messages or advertisements;
  • Use our services for the purpose of finding sexual partners. In particular this means that personal space must be respected and that hosts must never impose a shared sleeping surface.
  • Hosts must allow their guests to sleep on a separate sleeping surface, which may simply be space on the floor if this is clearly agreed at the time the hosting is agreed;
  • Post pornographic or sexually explicit content or images showing genitalia;
    Post or publish any personal data about other users, including photos, without their permission;
  • Use our services for unsolicited messages with no connection to the purpose of Dirtyroad or for unsolicited invitations;
  • Use our services to collect donations for any other entity than Dirtyroad; or
    assist any third party in doing any of the foregoing.
  • Dirtyroad reserves the right to block you from participating in selected areas of the website or to cancel your membership/delete your account in cases of violations
    of these regulations (see section 9. “Cancellation of membership” for further details).

7. Content

Content that you own remains in your ownership when you post it on Dirtyroad.

You are responsible for all the content you upload, copy, distribute and display using our services.

For content that is protected by copyright you must be the copyright owner or have the consent of the copyright owner to use it that way.

When posting pictures, you are responsible for obtaining the authorization to post from all private people portrayed in them.

For the limited purpose of providing the service, you give Dirtyroad a license to use, host, store, copy, distribute and display the content you upload to the Dirtyroad website, subject to your privacy settings. Dirtyroad cannot use your content for any other purposes – such as promotional material or newspaper articles – unless you explicitly give your consent to that use, and if such a possibility arises, we will ask you. Dirtyroad cannot and will not use your content for any commercial purposes.

When you post content on Dirtyroad, you participate in a community. If you choose to delete your profile, some of your content will remain in the system – including but not limited to, private messages you have sent to other people, profile comments, activities, and suggestions.

Other content, including your profile and photos, we will delete upon cancellation of membership. We will make every reasonable effort to delete this content in a timely manner. The license granted above expires upon deletion.

8. Termination

If you are in breach of these terms or any other policies in place, we may at our discretion suspend or terminate your account.

Dirtyroad reserves the right to refuse or cancel your membership for the following reasons:

  • Requirements for membership are not fulfilled (physical person, at least 18);
  • The data in your account is false;
  • Your email address is not confirmed;
  • You engage in any behaviour which is not in line with section 4 of these terms or which endangers or harms other Dirtyroad members;
  • You have not logged in to Dirtyroad for over 2 years; or
  • Any other violation of the Terms of Use.

Dirtyroad also reserves the right to cancel a membership for other reasons upon the recommendation of the Safety Team.

You may cancel your membership yourself at any time.

When your membership is cancelled, your profile. Your community contributions – that is, content that you shared with others during your membership – will remain visible.
This includes, but is not limited to activities you created.

In certain circumstances (detailed in the Dirtyroad Privacy Policy link) some data from cancelled accounts may be stored for longer periods, but it will no longer be visible. For example, in the case of a cancellation as a result of serious abuse, Dirtyroad reserves the right to store information for an indefinite time to prevent the abuser from creating a new account.

If the account was cancelled as a result of serious abuse, Dirtyroad reserves the right to ban the user permanently from setting up another account.
